The buying of real estate in Mexico by foreigners and especially the bay area has become much easier. If you hire a professional real estate agent like me, likely you will only be required to decide which property that you wish to purchase, sign a few papers, wire the cost of the property to an international escrow service provider, wait 2 months and move in.
The deed to your property will be held by a bank of your choice with a federal charter in Mexico. The price of this trust account varies a bit, but averages $800 per year. This trust is called a Fideiescomo and you have all of the rights of ownership. The bank trust is renewable after 50 years for a second fifty years. At the time the deed (escritura) is being prepared, you may designate alternate beneficiaries of the trust which will simplify matters for the handling of your estate.
Property Taxes are incredibly low in Mexico, typically less for one year than for one month elsewhere.
If you wish to rent your property in Mexico, you are required to list your property as a rental and pay 15% IVA (value added tax) on your rental income, but no income tax is due in Mexico.
If you finance your purchase, the interest on your mortgage is a tax deductable expense in the US.
